These Terms and Conditions govern use of the Academy’s website and, where applicable, online enquiries, registrations, bookings and purchases. They should be read together with the Academy’s Refund Policy, Cancellation Policy and Privacy Policy.

1. About these Terms

By accessing or using the website of The Academy of Excellence for Professional Development (the “Academy”, “we”, “us” or “our”), you agree to these Terms and Conditions. If you register for a course, submit an application, make a booking or purchase a service through the website, these Terms also form part of the agreement between you and the Academy, subject to any course-specific written terms provided to you.

Nothing in these Terms is intended to exclude, restrict or waive any right that cannot lawfully be excluded under South African law, including rights under the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”).

2. Website information

We aim to keep information about courses, accreditation, schedules, venues, entry requirements, fees and services accurate and current. Course availability, dates, facilitators, venues and delivery methods may change where reasonably necessary. Material changes affecting a confirmed learner will be communicated as soon as reasonably practicable.

Accreditation or professional recognition applies only where expressly stated for a particular programme and is subject to the scope, conditions and validity of the relevant accreditation or approval. Users should rely on the current course description and enrolment documentation for the specific programme.

3. Eligibility and learner information

You must provide complete and accurate information when enquiring, applying, registering or paying. Certain programmes may have minimum age, educational, professional, identification, clinical placement, attendance or other entry requirements. Registration may be declined or deferred where mandatory requirements are not met.

Where a learner is a minor, the Academy may require consent and contracting by a parent or legal guardian.

4. Registration and acceptance

Submitting an enquiry or application does not by itself guarantee a place. A place is confirmed only when the Academy has accepted the registration and any required deposit or fee has been received, unless the Academy confirms otherwise in writing. Places may be limited and allocated according to the Academy’s published or communicated registration process.

5. Fees and payment

• Fees will be communicated before a learner commits to a paid programme and will indicate, where applicable, what is included.
• Payment must be made using an approved payment method and by the due date stated on the invoice, quotation, registration form or payment plan.
• The learner or payer is responsible for using the correct payment reference and for providing proof of payment when requested.
• A payment plan does not waive the obligation to pay the full amount due under the agreed plan, subject to any lawful cancellation or refund rights.
• The Academy may withhold non-essential services or access where amounts are overdue, provided this is lawful and reasonable in the circumstances.

6. Course delivery, attendance and assessment

Learners are responsible for meeting attendance, participation, assessment and conduct requirements communicated for their programme. Successful completion, a certificate of attendance, a statement of results or a qualification is not guaranteed merely because fees have been paid. Outcomes depend on the applicable programme requirements.

Where practical or regulatory requirements apply, learners must comply with safety rules, professional standards, placement rules and instructions of facilitators or host sites.

7. Changes, postponements and cancellations by the Academy

The Academy may reasonably reschedule, relocate, change the delivery format of, postpone or cancel a programme because of insufficient enrolment, facilitator availability, venue issues, safety concerns, regulatory requirements, force majeure or other circumstances beyond reasonable control. Where the Academy cancels a paid programme and does not provide an acceptable alternative, the learner will be entitled to an appropriate refund for the affected service in accordance with applicable law and the Refund Policy.

8. Learner cancellations

Learner cancellations are governed by the Academy’s Cancellation Policy and applicable consumer law. Any cancellation charge will be reasonable and determined with regard to the circumstances, including the notice given, the nature of the service, costs already incurred and the Academy’s ability to fill the place.

9. Refunds

Refund eligibility and processing are governed by the Academy’s Refund Policy and applicable law. No clause in these Terms limits a consumer’s statutory right to a refund or other remedy where such right applies.

10. Website accounts and acceptable use

• Do not misuse the website, attempt unauthorised access, introduce malicious code, interfere with website operation or use the website for unlawful purposes.
• Keep any login credentials confidential and notify the Academy if you reasonably suspect unauthorised access.
• Do not copy, scrape, reproduce or commercially exploit website content except as permitted by law or with written permission.

11. Intellectual property

Unless otherwise stated, the Academy owns or lawfully uses the website content, course materials, branding, logos, graphics, training resources and other intellectual property made available through its services. Course materials are supplied for the registered learner’s personal educational use and may not be reproduced, sold, uploaded, distributed or used to train others without written permission, except where law permits otherwise.

12. Third-party services and links

The website may link to third-party websites, payment providers, learning platforms or other services. Those services may have their own terms and privacy practices. The Academy is not responsible for third-party content or systems that it does not control, but this does not limit any responsibility the Academy has under applicable law.

13. Privacy and communications

Personal information is processed in accordance with the Academy’s Privacy Policy and applicable data-protection law, including the Protection of Personal Information Act 4 of 2013 (“POPIA”). Marketing communications will be handled in accordance with applicable consent and opt-out requirements.

14. Disclaimer and limitation

The Academy will exercise reasonable care in providing its website and services. To the maximum extent permitted by law, the Academy is not liable for loss caused solely by events beyond its reasonable control, misuse of the website, or reliance on information that the user knew or reasonably should have known was outdated or inaccurate. Nothing in these Terms excludes liability or remedies that may not lawfully be excluded.

15. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. The parties should first attempt to resolve complaints directly and in good faith. A consumer may also use any complaint, ombud, regulator, tribunal or court process available under applicable law.

16. Changes to these Terms

We may update these Terms from time to time. The current version will be published on the website with its effective or review date. Material changes affecting an existing paid agreement will not retrospectively remove rights already accrued.
