This policy sets out how learners may cancel registrations or bookings and how the Academy handles postponements and cancellations. Statutory consumer rights always take precedence where applicable. |
1. Learner cancellation of an advance booking
A learner may cancel an advance course booking, reservation or registration by giving the Academy written notice. The Academy may charge a reasonable cancellation fee where permitted by the CPA. The fee will not be punitive and will be assessed with regard to the circumstances.
2. Factors used to determine a reasonable cancellation charge
Where the Academy can avoid or recover a cost, it will take that into account. A cancellation fee will not be imposed where doing so would be unlawful.
3. How to cancel
Cancellation must be submitted in writing using the official Academy contact details. The notice should include the learner’s full name, course, scheduled date, invoice or registration reference and reason for cancellation. The effective cancellation date is the date on which the Academy receives the notice.
4. Transfers and substitutions
Where operationally and academically possible, the Academy may allow a learner to transfer to another available date or permit a suitable substitute learner. Any transfer is subject to programme entry requirements, available capacity, accreditation rules and costs already incurred. The Academy will communicate any applicable administration or price difference before confirming the transfer.
5. Failure to attend
If a learner does not attend and has not cancelled or arranged a transfer, the Academy may treat the booking as a late cancellation and may retain an amount representing a reasonable cancellation charge and services or costs already incurred, subject to applicable law.
6. Cancellation or postponement by the Academy
The Academy may cancel, postpone, reschedule, relocate or change the delivery format of a programme where reasonably necessary, including because of insufficient enrolment, facilitator illness or unavailability, venue or equipment problems, safety concerns, regulatory requirements, public emergencies, severe weather or other events beyond reasonable control.
Where a material change is made, the Academy will notify affected learners as soon as reasonably practicable and will offer an appropriate option, which may include transfer to another date, an alternative delivery arrangement, credit, or a refund where required by law or where the Academy cannot provide an acceptable alternative.
7. Direct marketing and electronic transactions
Where a statutory cooling-off right applies because of the manner in which a transaction was concluded, a learner may exercise that right within the period and on the conditions prescribed by the applicable legislation. This policy does not reduce those rights.
8. Fixed-term agreements
If a learner enters into a fixed-term consumer agreement to which section 14 of the CPA applies, the learner may have additional cancellation rights, including cancellation on the notice required by law subject to a reasonable cancellation charge. The Academy will apply the law to the specific agreement.
9. Effect of cancellation on refunds and certificates
Any refund following cancellation is handled under the Refund Policy. A learner who cancels before satisfying the programme’s completion requirements is not entitled to a completion certificate, qualification or result that requires those requirements to have been met.
10. Exceptional circumstances
The Academy may consider documented exceptional circumstances, such as serious unforeseen events, when assessing transfers or cancellation charges. Consideration is discretionary unless the law requires a particular outcome, and similar cases will be handled consistently.
